PIRATE PARTY DOCTRINE

Right to Scienter - Facilitate the emerging information society:  We can imagine no reason why acquisition of information should be impeded by governments, militaries, corporations, or anybody/anything else.  You can pry our computer mice from our cold dead fingers before you take away from us our right to scienter.  Conversely, we feel that no exogenous party has an obligation to supply us with scienter:  the quest for scienter is the individual's obligation.  In fact, we wish the government and corporations would get out of the business of educating us.

Freedom from fear of learning:  We do not like the police looking over our shoulder as we learn.  We reject any inference that the actions we take to learn are intrinsically suspect and subject to policing.  "Learning about" is not the same as "doing".  Government must learn to restrict itself to locating and restraining "doers" of bad things.  We suspect,unfortunately, that the police wish us to remain as uninformed as they are.

The electronic landscape is our agora:  each man. woman, and child is an emperor in our agora.  If you have agoraphobia, you need not come.  Put another way, the internet is our Hyde Park Speakers Corner.

Privacy:  We stand for the inherent natural right of privacy - on the internet and in our lives.  Collecting data about us, even when putatively de-personalized, is reprehensible.

Transparency, ab initio:  We believe that every act of civil servants, elected law-makers and elected public executives should be instantly transparent.  That is true even if transparency requires a dedicated real-time data-feed of the product of government's word-processors and telephone conversations. We want "to be there", ab initio, when public policy is formed.

Instant Plebiscites:  We insist that political translation devices be instituted for real-time instant plebiscites.  This is the internet's gift to us.  Instant plebiscites are not to dissuade our elected representatives from following a higher calling:  but rather only to let them know what we are thinking between elections.

IP- Copyrights:  Intellectual Property protection must only extend to proscribing explicit commercial use:  with the burden on the claimant that any violative usage is both commercial and materially damaging to the putative owner of intellectual property.  We condemn neither the notions nor theories of intellectual property;  and we elevate intellectual property to a sacrosanct common-law right but only to the extent that intellectual property is unjustly converted for both profitable and explicitly commercial use.  To wit:  the dance that Wikipedia must do today to simply report on ideas and information is plainly unacceptable.

IP - Patents:  Patent protection schemes as presently instituted are inherently monopolistic.  The common-law right of true innovators to benefit from their ideas must be protected in some other way.

IP - Trademarks and Service marks:  We have no position on these two putative forms of "intellectual property": except to say that we find them not very intellectual.  The assertion of common-law Trade and Service Marks will be supported by the party but formal registration to give "putative notice" of these "putative rights"  is no longer necessary and registration by Governments for purely punitive purposes should be terminated.

Ad hominem:  We eschew the "ad hominem" attack.  We seek no personal attack on civil servants, elected law-makers and elected public executives who seek to act for us.  Rather, we wish them not to act for us except in the most perfectly and minimally intrusive manner.  [In that sense, we may be similar to the US Tea Party - but without the Tea.]

Free Speech:  The Pirate Party is not a party of free speech:  there is neither right to "shout fire in a crowded theater" nor to foment violence through speech..  When the locus of actionable violence is actually in the minds of the audience:  no pejorative connotation shall attach to the incidental speaker.  However, we do believe that people who shout fire in crowded theaters should perhaps not be allowed in theaters:  but they may continue to shout fire outside in clear open spaces.

Corporations and speech:  a corporation is devoid of political passion.  Thus, it can not be said that corporations can have any truly independent political speech.  Therefore, we argue that the US Constitution should be amended so as to proscribe the notion that corporations are full legal persons with a natural person's right to free speech

The purpose of corporations:  the over-arching principal purpose of corporations is to offer limited liability to corporation's owners and operators. Once limited liability is established, the US corporation may only engage in business operations for the sole purpose of making a profit.  By universal agreement of all US States, business corporations may not engage on eleemosynary or political activities.

Piercing of the Corporate Veil:  Where a chartered limited-liability corporation is hijacked by either its owners or operators and converted to a political speech device, broad personal liability for that speech shall attach to the owner/operators of the corporation.  In other words, the owner/operators pierce their own corporate veil by asked the corporation to speak for them.

Corporations and no corporate income tax:  We do not believe that corporations can pay income taxes.  Any tax burden placed on a corporation will be passed on to the consumers.  The income of corporations is to be parsed and allocated to each owner of that corporation:  and taxed to the owner.

Calculation of corporate income:  the profit of corporations will be calculated on a "cash basis":  there will be no accrual accounting of current items: and there will be no capitalization of items for depreciation purposes.  Worldwide cash income is immediately taxable to the natural person owners of corporation in their respective tax domiciles.  Except:  every tax domicile must have a tax collection system which is on a par with world standards.
